§ 1 Scope & Contractual Partners
These General Terms and Conditions (T&C) apply to all contracts regarding the rental of apartments for accommodation purposes as well as all other services provided by DL Real Estate & Trade GmbH (hereinafter referred to as the “Accommodation Provider”).
The contractual partner of the guest is DL Real Estate & Trade GmbH, Achter De Höf 8, 25474 Ellerbek.
§ 2 Reservations
By making a booking, the guest offers to conclude an accommodation contract. This contract is formed upon confirmation by the Accommodation Provider.
Offers are subject to change and non-binding. There is no entitlement to the conclusion of a contract.
There is no entitlement to a specific apartment. The Accommodation Provider may assign bookings within the same category.
§ 3 Cancellation Policy
A booking is considered guaranteed as soon as payment has been made.
Cancellations must be made in writing.
The following cancellation fees apply:
- Up to 120 days prior to arrival: free of charge
- 119–60 days prior to arrival: 20%
- 59–30 days prior to arrival: 50%
- 29–10 days prior to arrival: 75%
- 9–3 days prior to arrival: 85%
- Less than 3 days prior to arrival or No-Show: 100%
The decisive factor is the time at which the cancellation notice is received by the Accommodation Provider.
§ 4 Prices
The prices stated at the time of booking shall apply.
All prices are gross prices including statutory taxes.
Visitor’s taxes (Kurtaxen) and similar local municipal levies are fundamentally calculated separately and must be paid by the guest.
We reserve the right to make price adjustments in the event of changes to tax rates.
§ 5 Terms of Payment
The total amount must be paid in advance.
Accepted payment methods: Credit Card, PayPal, SEPA, Sofort, Apple Pay, Klarna.
Additional costs or damages may be charged subsequently.
Invoices will be provided digitally.
§ 6 Check-in & Check-out
Check-in and check-out times are apartment-specific and will be communicated to the guest in the booking confirmation.
Early check-in and late check-out may be made possible depending on availability and for an additional fee. There is no entitlement to this.
The guest is obliged to fully and truthfully complete the online check-in form provided by the Accommodation Provider prior to arrival.
The loss of keys or access media will be charged at a minimum of €75.
§ 7 Use of the Apartments
The apartments may be used exclusively for accommodation purposes.
Subletting is strictly prohibited.
Commercial use is not permitted.
§ 8 Liability
The Accommodation Provider is liable without limitation in cases of intent and gross negligence.
In cases of slight negligence, liability is limited to the breach of essential contractual obligations (cardinal obligations).
Statutory regulations apply regarding items brought into the accommodation by the guest.
No liability is assumed for vehicles.
§ 9 Customer Data & Identity Verification
Providing an e-mail address and phone number is mandatory.
The Accommodation Provider is entitled to request a valid identity document for identity verification purposes.
Bookings may be cancelled in the event of suspected misuse or false statements.
§ 10 Termination by the Accommodation Provider
Termination of the contract is particularly possible in the event of:
- false statements
- violation of these Terms and Conditions
- endangerment of operations
- illegal use of the property
§ 11 Vouchers / Gift Cards
Vouchers cannot be paid out in cash.
Any remaining balance remains valid.
§ 12 Smoking Ban
Smoking is strictly prohibited in all apartments.
In the event of a violation, a cleaning fee of at least €500 will be charged.
§ 13 Parties & Noise
Parties are strictly prohibited.
In the event of a violation, a contractual penalty of at least €800 will be charged.
Noise sensors may be utilized (no audio recordings are made).
§ 14 Damage & Theft
The guest is liable for all caused damages as well as any resulting consequential costs.
§ 15 Pets
Pets are generally allowed, but only upon prior registration and confirmation by the Accommodation Provider.
The individual regulations of the respective accommodation apply, which are displayed during the booking process or in the booking confirmation.
Additional fees will be charged for bringing pets.
The guest is liable for all damage caused by the pet as well as for any additional cleaning efforts required.
The Accommodation Provider reserves the right to reject pets in individual cases.
§ 16 Maintenance & Duty of Care
The apartment must be treated with care.
Any damages must be reported immediately.
§ 17 Group Bookings
Special conditions may apply to group bookings.
§ 18 Internet Use
Internet use is permitted only within the statutory legal framework.
Misuse is strictly prohibited.
§ 19 Quiet Hours
Quiet hours must be observed daily from 10:00 PM to 7:00 AM (22:00 to 07:00).

§ 21 Final Provisions
German law shall apply.
The place of jurisdiction is – to the extent permitted by law – the registered office of the company.
Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
The Accommodation Provider does not participate in dispute resolution proceedings before a consumer arbitration board.
